1. Introduction
1.1 This Privacy Policy governs the collection, use, disclosure and retention of personal information by Ariadne Leather in connection with the Website and the Services.
1.2 Ariadne Leather is a sole proprietorship carrying on business in Delta, British Columbia, Canada. Ariadne Leather is the organization responsible for the personal information under its control.
1.3 This Privacy Policy is intended to comply with the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”) and the Personal Information Protection Act (British Columbia) (“PIPA”).
1.4 By accessing the Website, submitting information through it, or placing an order, you acknowledge that you have read and understood this Privacy Policy.
2. Definitions
2.1 In this Privacy Policy:
- “Ariadne Leather”, “we”, “us” and “our” mean Ariadne Leather, a sole proprietorship carrying on business in Delta, British Columbia, Canada.
- “Personal Information” means information about an identifiable individual, as defined in PIPEDA and PIPA.
- “Service Provider” means a third party engaged by us to process Personal Information on our behalf or to perform functions necessary to operate the Website or fulfil an order.
- “Services” means the sale of goods and any related services offered through the Website.
- “Website” means ariadneleather.ca and its subdomains.
- “you” and “your” mean the individual accessing the Website or purchasing the Services.
3. Information We Collect
3.1 Information you provide to us
When you place an order, register an account, submit a review, or contact us through the Website, we may collect:
- your name;
- your email address;
- your billing and shipping address, including street, city, province or state, postal or ZIP code and country;
- the contents of any message, order note or review you submit.
3.1.1 We do not collect, process or store complete payment card numbers. Payment card details are submitted directly to our payment processor and are handled by that processor in accordance with clause 6.
3.2 Information collected automatically
When you access the Website, the following information is collected automatically:
- Internet Protocol (IP) address;
- browser type and version, operating system and device type;
- pages accessed, date and time of access, and duration of visit;
- referring page or search term;
- diagnostic and error data generated by the Website or its host.
4. How We Use Personal Information
4.1 Personal Information is collected, used and disclosed for the following purposes:
- to process, manufacture, fulfil and deliver orders, and to communicate with you regarding an order;
- to administer a warranty claim, repair or return;
- to respond to enquiries submitted through the Website or by email;
- to establish and administer a customer account, where one is created;
- to operate, maintain and secure the Website, and to analyse its use;
- to measure the effectiveness of advertising, as described in clause 7;
- to comply with applicable legal, tax and record-keeping obligations.
4.2 Personal Information will not be used for a purpose materially different from those set out in clause 4.1 without your consent, except where permitted or required by law.
4.3 We do not currently send marketing communications. Should we do so, enrolment will be by express opt-in and every communication will contain an unsubscribe mechanism.
5. Consent
5.1 By providing Personal Information to us, you consent to its collection, use and disclosure in accordance with this Privacy Policy.
5.2 Where required by law, express consent will be obtained. In other cases consent may be implied from your conduct, including placing an order or submitting an enquiry.
5.3 You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us under clause 15. Withdrawal of consent may prevent us from providing the Services.
6. Disclosure of Personal Information
6.1 We do not sell Personal Information, and we do not disclose Personal Information for the marketing purposes of any third party.
6.2 Personal Information is disclosed to the following categories of Service Provider, in each case limited to the information required for the stated function:
- Payment processing. Card payments are processed by WooPayments (operated by Stripe) and, where selected by you, your chosen payment provider. Payment and billing details are transmitted directly to the processor and are processed under that processor’s own privacy policy. We receive confirmation of payment together with order and billing details, and do not receive complete card numbers.
- Shipping and fulfilment. Canada Post receives the recipient name and delivery address required to calculate shipping rates and effect delivery.
- Website hosting. The Website is hosted in Canada by Web Hosting Canada (WHC), whose infrastructure stores the Website database, including order and account records.
- Advertising and measurement. Google LLC, in connection with the tags described in clause 7.
- Review display. Customer review content is rendered through a third-party widget operated by Trustindex, which may set its own cookies and receive your IP address in the course of loading.
6.3 Personal Information may also be disclosed:
- where required or permitted by applicable law, or in response to a valid demand from a court, regulator or other public authority;
- where reasonably necessary to investigate suspected fraud or unlawful activity, to enforce our terms, or to protect the rights, property or safety of any person;
- to a purchaser or successor in connection with a merger, acquisition, financing or sale of all or part of the business, in which case customer records may be transferred as an asset. Notice will be provided before Personal Information becomes subject to a different privacy policy.
7. Cookies and Tracking Technologies
7.1 A cookie is a small file stored on your device. The Website uses cookies and similar technologies, including web beacons and scripts, in the following categories:
- Strictly necessary cookies — session cookies required to operate the shopping cart, checkout and account login. The Services cannot be provided without them.
- Functional cookies — persistent cookies that retain preferences so that they need not be re-entered.
- Advertising and measurement cookies — described at clause 7.2.
7.2 Google advertising tags. The Website operates a Google Ads global site tag bearing conversion identifier AW-17583546118. This tag sets cookies administered by Google LLC which enable Google to measure whether an advertisement resulted in a visit or a purchase, and which may be used for remarketing, being the display of Ariadne Leather advertisements to you on other websites.
7.3 You may disable personalised advertising through Google Ads Settings, or install Google’s opt-out browser add-on. Configuring your browser to block third-party cookies will also prevent operation of these tags.
7.4 You may configure your browser to refuse cookies or to notify you when a cookie is set. If all cookies are refused, portions of the Website, including the cart and checkout, will not function.
7.5 The Website does not currently present a cookie consent banner. Where you are located in a jurisdiction requiring prior consent to advertising cookies, you should apply the controls described in clause 7.3 before browsing.
8. Transfer of Information Outside Canada
8.1 Certain Service Providers identified in clause 6.2 operate infrastructure outside Canada. Personal Information may therefore be stored or processed outside British Columbia and outside Canada, and may be accessible to the courts, law enforcement and national security authorities of those jurisdictions.
8.2 We require Service Providers to protect Personal Information by means comparable to those set out in this Privacy Policy. By providing Personal Information and placing an order, you consent to such transfer.
9. Retention
9.1 Personal Information is retained only for as long as necessary to fulfil the purposes set out in clause 4 or as required by law, and specifically:
- Order and transaction records — for the period required by Canadian tax and business record-keeping requirements, being six years from the end of the taxation year to which they relate;
- Account information — until deletion of the account is requested;
- Correspondence — for so long as required to respond to the enquiry or administer a warranty claim, and thereafter destroyed;
- Usage data — for a shorter period, and by Google in accordance with its own retention practices.
10. Your Rights and How to Exercise Them
10.1 Subject to the exceptions provided by PIPEDA and PIPA, you have the right to:
- be informed of the existence, use and disclosure of your Personal Information and be given access to it;
- request correction of inaccurate or incomplete Personal Information;
- request deletion of Personal Information that we are not required to retain. Records forming part of a completed transaction must be retained in accordance with clause 9.1;
- withdraw consent in accordance with clause 5.3.
10.2 Requests should be directed to [email protected]. We will respond within 30 days of receipt, being the period prescribed by PIPEDA, or will notify you of any permitted extension.
10.3 Where an account has been created, certain Personal Information may be reviewed and amended directly through the My Account area of the Website.
10.4 We may require verification of identity before giving effect to a request under this clause.
11. Safeguards
11.1 The Website is served over HTTPS. Payment card details are handled by the payment processor and are not stored by us.
11.2 We maintain security safeguards appropriate to the sensitivity of the Personal Information held. No method of transmission over the internet or of electronic storage is entirely secure, and absolute security cannot be guaranteed.
12. Children’s Privacy
12.1 The Website is not directed to children under the age of 13, and we do not knowingly collect Personal Information from them. A parent or guardian who believes that a child has provided Personal Information should contact us under clause 15, and the information will be deleted.
13. Third-Party Websites
13.1 The Website may contain links to websites operated by third parties. We do not control and are not responsible for the content or privacy practices of those websites. You should review the privacy policy of any website you visit.
14. Amendments
14.1 This Privacy Policy may be amended from time to time. The amended version will be posted on this page bearing a revised “last updated” date and takes effect upon posting.
14.2 Continued use of the Website following posting constitutes acceptance of the amended Privacy Policy.
